Q: I bought window tint from Home Depot. The tint caused my window to crack. That is going to cost me $400 to replace. I know I have a long shot at winning a court settlement, but I have to try. However my question is not about the case. It is about whether I can sue here in CA. I only want to know if I can sue here in CA. I have to wonder because they are based in VA, but the product was bought at a Home Depot store in my hometown of CA. Do I sue the maker of the window tint, Gila? Or do I sue Home Depot? Both? Can I sue? Any ideas?
A: You have to sue in the proper jurisdiction. If you are suing to get your money back for the product, you have to sue in the county where the transaction took place. If you want to sue for the broken window, that would probably be the same. Your county court will have a small claims adviser that can help you know the correct jurisdiction.
