Q: Is it legal for Alliance One(in San Diego,Ca.)to call me relentlessly with threats of having arrest warrants issued, unless receipt of entire balance is forthcoming? Are they in a position to initiate legal action?
A: This is not the middle ages. We do NOT have debtor prisons. There are people that have gone to jail for fraud and bad checks, but that is a deliberate and malicious act. When the creditor calls again tell them that you do NOT want them to contact you by phone any longer and that mail contact is all you'll review. They MUST follow this under the Fair Credit Act. They CAN sue you in court, but unless the amount is very large 1000+ that is also unlikely. Them threatening you with this garbage is just a sad tactic of unscrupulous companies. If you are concerned about jail time consult a lawyer to ensure that it's not something they can do. At worst they will win a judgment in court that will show up on your credit report until paid off.
